Terms of Service

1. Agreement

These terms are an agreement between you and Lightning Studio LLC (Florida, USA), "we" or "us", about the True Odds app and its services. By using True Odds you accept these terms and our Privacy Policy. If you don't accept them, please don't use True Odds.

2. Adults only

True Odds is for adults. You must be at least 18, or the age of majority where you live if that is higher, and allowed by the laws where you live to play social casino games.

3. What True Odds is

True Odds is a social casino game, for entertainment. You play casino table games with chips that are play money.

• True Odds does not offer real-money gambling. Nothing in it can be won for money, prizes or anything of value.
• Practice or success at social casino gaming does not imply future success at real-money gambling.
• We don't link to, promote or direct you to real-money gambling.

4. Your account

The app creates a guest account for you on your phone. There is no username or password: the account is tied to secrets the app keeps in your phone's secure storage. If you remove the app, lose or reset your phone, or its secure storage is lost, you may lose the account, and we may not be able to restore it or its chips. Your account is for you alone: don't sell, share or transfer it.

5. Chips

• Chips have no cash value. They are not money or property. They give you a limited, personal, revocable licence to use a feature of the game. They can never be cashed out or redeemed for money, goods or anything else of value, by us or by anyone.
• Chips can't be transferred. They can't be sent, given, traded or sold to anyone, inside or outside the app.
• Bought chips don't expire. All chips are lost if your account is deleted, or closed under section 11.
• We may change how chips are earned and used in future play: the free chips, bonuses and refills, table stakes, and chip packs. We won't reduce the chips already in your balance, except to correct an error or as section 6 says for refunds.

6. Buying chips

• Chip packs are sold through the App Store and Google Play, under their terms. The price is the one the store shows you, with any taxes the store adds.
• Your chips are added once our servers have checked the purchase with the store, usually within seconds. If a purchase doesn't arrive, write to us with the store's receipt.
• Purchases are final, except where the store's refund policy or the law where you live gives you a refund. Refunds are made by Apple or Google, not by us.
• If a purchase is refunded or reversed, we take back the chips it gave you, down to a balance of zero.
• Nothing you buy changes the odds, and we don't sell random items.

7. Free chips and rewarded ads

You can play without paying: there are welcome chips, a daily bonus and a free refill when you run out. You can also choose to watch a short video ad for free chips. Our servers pay an ad's reward only after the ad network confirms the view, and there is a daily limit. The amounts and limits may change.

8. Fairness

• Every round is decided on our servers, using random numbers from a seed pair you can verify (see Fairness). The app shows the server's results; our server's records of a round and of your balance are the ones that count.
• Each table shows its rules and the house edge of each bet. Nothing about you, such as your balance or your purchases, affects the cards.
• If a technical error affects a round or a balance, we may correct it.

9. Responsible play

You can set a session reminder, and take a break from the tables for 30 days, 6 months, a year or for good. While a break runs, the tables won't deal you new rounds and the shop offers nothing. A break can be made longer but can't be shortened or ended early. See Responsible play for more, and for organisations that can help.

10. Rules of play

Play fair. Don't:

• cheat, use bots or automation, or exploit a bug (if you find one, please tell us);
• interfere with our servers, or reverse engineer the app to gain chips or an advantage;
• create accounts to collect free chips, or try to buy, sell or move chips or accounts;
• use True Odds where it is against the law, or for any commercial purpose.

11. Suspension and closure

We may suspend or close an account that breaks these terms, or where the law requires it. Chips in a closed account are forfeited, with no compensation, except where the law requires otherwise.

12. Deleting your account

You can delete your account at any time, in the app or by email (see Delete your account). Deleting can't be undone, and the account's chips are lost.

13. Changes to True Odds

We may change, add or remove games, tables, features, rewards and chip packs, and some features may not be available everywhere. We may stop offering True Odds; if we do, we'll give notice in the app where we reasonably can.

14. Licence and ownership

We give you a personal, non-exclusive, non-transferable, revocable licence to use the True Odds app for your own entertainment, under these terms. True Odds and its content belong to us or our licensors. Parts of the app are covered by their own open licences, such as its fonts' SIL Open Font Licence.

15. Disclaimer

To the extent the law allows, True Odds is provided "as is" and "as available", without warranties of any kind. We don't promise it will always be available or free of errors.

16. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost chips, data or profits. Our total liability for any claim about True Odds is limited to the greater of what you paid for chips in the 12 months before the claim and US$50. Nothing in these terms limits liability that the law doesn't allow to be limited, or your rights as a consumer that can't be waived.

17. Apps from Apple's App Store

If you got True Odds from Apple's App Store:

• This agreement is between you and Lightning Studio LLC, not Apple. We, not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet a warranty that applies, you may notify Apple, and Apple will refund the price you paid for the app, if any. Apple has no other warranty obligation for the app, to the extent the law allows.
• We, not Apple, are responsible for any claims about the app, including product liability, legal or regulatory requirements, consumer protection, and claims that the app infringes someone's intellectual property.
• You confirm that you aren't in a country under a U.S. Government embargo or designated as supporting terrorism, and aren't on a U.S. Government list of prohibited or restricted parties.
• You must follow the terms of third parties you use with the app, such as your mobile carrier.
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

18. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Disputes will be decided by the state or federal courts in Florida, unless the law where you live gives you the right to bring a claim in your local courts.

19. Changes to these terms

If we change these terms, we will update them here and change the effective date at the top. If a change matters, we will tell you in the app before it takes effect. If you keep using True Odds after that, the new terms apply.

20. General

These terms and our Privacy Policy are the whole agreement between you and us about True Odds. If part of these terms can't be enforced, the rest still applies. Not enforcing a part of these terms doesn't waive it. We may transfer these terms as part of a sale or merger of our business; you may not transfer them.
